I drove off after a black-ice crash near Conway, did I ruin my case?
No - leaving without an Arkansas State Police report does not automatically kill your injury claim. That is the bad advice people repeat after winter crashes on I-40, U.S. 64, and other highways around Conway.
What it does do is make the claim harder.
Arkansas is an at-fault insurance state, so the key question is still who caused the wreck. If another driver was going too fast for conditions, following too closely, or lost control on black ice and hit you, their liability coverage can still apply even if you drove away. Arkansas drivers are only required to carry $25,000 for one injured person, $50,000 per crash, and $25,000 for property damage, so the facts matter fast.
The mistake to fix now is the missing evidence.
If the crash happened on a state or federal highway near Conway, Arkansas State Police usually handles those wrecks. If it was inside town, it may be Conway Police. Even if no officer came that night, you can still build the record with:
- photos of the damage, ice, skid marks, and roadway
- names of witnesses or passengers
- repair estimates
- ER, urgent care, or clinic records tied to the crash date
- the other driver's insurance and plate information
Do not let an insurer spin "you left" into "you must not have been hurt." Delayed pain is common after cold-weather crashes, especially neck, back, and shoulder injuries.
Also, do not miss the real deadline. In Arkansas, the general statute of limitations for most injury lawsuits is 3 years from the crash date. That is the deadline that ruins cases, not the fact that you didn't wait on the shoulder for a trooper.
If you reported the wreck late, that is damage control. If you never report it and never document treatment, that is when the case starts slipping away.
The information above is educational and does not create an attorney-client relationship. Every injury case turns on its own facts. If you're dealing with this right now, get a professional opinion.
